Microsoft Tax Illegal

Not only in France but also in Italy PC buyers can claim for reimbursement if they don't want to use the preinstalled Windows. These are the results of judgements against the hardware manufacturers HP and Acer. In Germany there is no equivalent judgement known but the daily Süddeutsche Zeitung reported that Dell credited a customer the amount of 78 Euro who replaced Windows with GNU/Linux.

Dell does refund Windows

I can confirm that Dell refunds Windows and MS Works in Germany although they only gave me ~35€ claiming that that was all they pay for these products.
I was actually to keep the discs containing the software and the License sticker; the woman on the hotline told me they would only be "retrieved virtually", i.e. not at all.
Also they tried to bribe me with a 1GB-USB-Stick (free of Charge and free Shipping) so I would accept the Windows EULA.

You should get a refund anywhere actually, because the MS XP Home EULA explicitly states that you do if you decline the EULA.
